Registration Our services are available only to registered users who can form legally binding contracts under applicable law. Our services are not available to minors. If you do not qualify, please do not attempt to use our services. Registration requires the completion of the user registration form with accurate and complete contact names, principal business address, telephone numbers, and e-mail addresses. Your membership to use TradeinWireless may be terminated or suspended by us if you do not comply with this Agreement, our policies and procedures, or for any reason we determine is necessary, in our sole discretion, to protect us and other users of the site. THE FOLLOWING APPLIES TO ALL ITEMS TRADED ON THIS SITE TradeinWireless.com provides an online vehicle for wireless companies to liquidate used and new wireless handsets and pagers. The online quote generator provides a firm quote in real time for registered users. We reserve the right to amend, cancel or alter these services at our sole discretion. Trade Acceptance Policy Your receipt of a trade confirmation only signifies that TradeinWireless.com will pay full value if the handsets/pagers sent are in acceptable condition as outlined below. No trade over 1000 handsets/pagers or $10,000 will be accepted online. Definitions of Condition Used - Used handsets will power-up and make a test call. They will not be crushed, water damaged or have broken LCD's. Cases should be complete and unbroken. All handsets shall have a valid ESN. Used pagers will power up with all functions in working order. They will not be crushed, water damaged or have broken or nonworking LCD's. Cases should be complete and unbroken. New - New handsets are defined as never been activated or programmed, in OEM boxes with charger and battery, and without writing on the boxes or ESN labels. They will power up and make a test call. They will not be crushed, water damaged or have broken or nonworking LCD's. The LCD's must be covered with lens-tape. Cases should be new. All handsets shall have a valid ESN. New pagers are defined as never been activated. They will power up with all functions in working order. They will not be crushed, water damaged or have broken or nonworking LCD's. Cases should be new. Payment Payment will be made within 45 days of the receipt of handsets/pagers. If there is a dispute in condition users will be notified by e-mail with an adjusted trade offer. If the adjusted offer is not acceptable, TradeinWireless.com will return the shipment. If the adjusted offer is accepted the adjusted payment will be made based on the date of the original trade. TradeinWireless.com will not be responsible for user delays. Pricing All pricing subject to change without notice. For all prices, products and offers, TradeinWireless.com reserves the right to make adjustments due to changing market conditions, product availability, and other extenuating circumstances. Expiration of Offer All trade offers will expire 30 days from the date of trade confirmation. All confirmed trade pricing will be honored within the 30 day period regardless of current pricing. QuickShip Terms and Conditions Handsets that are shipped using the quick ship option on TradeinWireless.com are subject to pricing and the accepted model list that is in effect at the time they are received not the time that they are shipped. User agrees that TradeinWireless.com's offer to purchase is final and binding. Prices and accepted models are subject to change without notice at the sole discretion of TradeinWireless.com. The online inventory system provides a preliminary quantity and price commitment for registered users. We reserve the right to amend, cancel or alter these services at our sole discretion. Order Acceptance Policy Orders are not binding upon TradeinWireless.com until accepted. Terms of payment are within TradeinWireless.com's sole discretion. Your receipt of an order confirmation signifies that TradeinWireless.com will, to the best of it's ability, provide all items requested. The User is responsible for sales and all other taxes associated with the order. No order over 200 handsets/pagers or $10,000 will be accepted online. Definitions of Condition New - New handsets are defined as never been activated or programmed, in OEM boxes with charger and battery in new OEM housings. New pagers are defined as never been activated in new OEM housings. TradeinWireless.com and it's affiliates are not OEM distributors. All items, unless stated otherwise, are acquired through secondary market sources. Refurbished - Refurbished handsets shall have electronically been returned to factory specs. Housings may, at the sole discretion of TradeinWireless.com, be OEM new or refurbished. Batteries shall be new OEM. Chargers may, at the sole discretion of TradeinWireless.com, be OEM new or refurbished. Handsets have been refurbished by either RMS Communications Group, Inc. or the manufacturer. Refurbished pagers shall have electronically been returned to factory specs. Housings may, at the sole discretion of TradeinWireless.com, be OEM new or refurbished. Pagers have been refurbished by RMS Communications Group, Inc. Warranty All products offered on TradeinWireless.com come with a 90 day warranty unless otherwise noted. Some products may still have a manufacturers warranty. Payment Methods Credit card charges are not submitted until time of shipment. TradeinWireless.com will accept cash or cashiers check on all COD orders. All COD orders are subject to prior credit verification. TradeinWireless.com will accept business checks for prepay orders, but allow 15 business days for clearing. Pricing All pricing subject to change without notice. For all prices, products and offers, TradeinWireless.com reserves the right to make adjustments due to changing market conditions, product availability, and other extenuating circumstances. Legal Compliance You agree to comply with all applicable laws, statutes, ordinances and regulations regarding your use of our service and your bidding on and purchase of items. Independent Contractor This Agreement and your membership in no way constitutes or gives rise to a partnership, joint venture or other relationship between the parties. Each of us will operate under the terms of this Agreement as an independent contractor and not as an agent for the other. Risk of Loss Title to merchandise herein being purchased is retained by the seller until merchandise are paid for by the purchaser and at that time title passes to the purchaser. Loss or damage that occurs during shipping by a carrier selected by TradeinWireless.com is TradeinWireless.com's responsibility. Loss or damage that occurs during shipping by a carrier selected by User is User's responsibility.
